Row over crisp factory’s payments for overtime

ONE of Uttoxeter’s biggest employers has insisted it is not breaching workers’ contracts by paying them basic rate for voluntary overtime.

The denial came after a worker at Glennans Crisps told the Post and Times he was unhappy basic rate was paid to staff volunteering for overtime, while a higher rate went to those working compulsory overtime.

The employee said that in his opinion the higher rate should be paid for all additional hours worked at the factory at Dovefields Industrial Estate.

He said: “I am unhappy with the new arrangements.

“Since the Tyrrells takeover of Glennans, they have stopped paying time and a half for overtime above and beyond the 48-hour working week as my original contract says.

“A notice put up in the yard for overtime says that only a basic hourly pay rate will be paid for those volunteering for extra hours.

“In my view, this is for commercial gain on the part of Tyrrells.”

Bosses at Tyrrells defended the decision to pay a basic rate to those requesting extra hours, while shelling out the higher rate for compulsory overtime.

A spokesman said: “The key difference here is that the company is not requesting an individual to work beyond their normal contracted hours.

“In fact, this scenario is where the employee is actively seeking additional hours on a voluntary basis.

“Therefore in this case we will do our best to accommodate extra hours.

“Within a number of contracts, there is clear guidance regarding overtime payment where the company requests it directly of an employee.

“The terms and conditions laid out regarding overtime are there to clearly show the obligations by both employees and the business where it is the company that asks an employee to work beyond their normal hours.

“If any of our employees are unclear about their working conditions then our team is always on hand to help with any questions they might have.

“There are of course moments in the year when some employees are actively seeking additional hours, such as in the run up to Christmas, beyond that which is requested by the company and under conditions which are exceptional to their contracted terms and conditions.

“Therefore, in some situations, rather than opt for the use of temporary staff, we would support our employees by offering additional working hours to those employees who have actively requested more hours on a voluntary basis.”
